Trademark & Brand Usage Policy

1. Purpose

This Policy identifies the trademarks, service marks, characters, and trade dress owned by Sports Media, Inc. and explains when you may use them and when you must ask first.

We want teachers to teach with our materials, retailers to sell our books, and the press to write about us. This Policy grants broad permission for those uses. It also protects the marks against uses that would confuse a parent about who stands behind a product, or place our characters in front of children in a context we would not choose.

Read this alongside our Copyright Policy and Terms of Service. Trademark and copyright are different. Trademark protects the names and logos that identify us as the source. Copyright protects the books, art, videos, and games themselves. A use may need permission under one, the other, or both.

2. Our Marks

The following are trademarks and service marks of Sports Media, Inc.

Company and brand marks

  • SPORTS MEDIA™ and SPORTS MEDIA, INC.™
  • CHAMPION MVP™
  • SPORTS MEDIA KIDS™
  • The Champion MVP logo and the Sports Media logo, in all versions and color variations

Series and title marks

  • LET’S PLAY™ and LET’S LEARN™ as used in our children’s sports series
  • The individual title marks in the series, including LET’S PLAY SOCCER™, LET’S PLAY BASKETBALL™, LET’S PLAY BASEBALL™, LET’S PLAY TENNIS™, LET’S PLAY SWIMMING™, LET’S PLAY VOLLEYBALL™, LET’S LEARN TRACK AND FIELD™, LET’S LEARN TO PLAY ICE HOCKEY™, LET’S COLOR™, and LET’S GO SWIMMING™
  • HELLO GIGI™ and HELLO PIP™

Character marks

  • ZOE™, MIKAH™, TT™, COACH CHAMP™, GIGI™, and PIP™, together with the visual designs, appearances, and depictions of each character

Trade dress

The distinctive cover design system, color palette, typography, character presentation, and page layout of the children’s sports series, taken as a whole.

2.1 Registration Status — Read This

The marks listed above are claimed as common-law trademarks and are not, at this time, registered with the United States Patent and Trademark Office.

Accordingly:

  • Use the ™ symbol with these marks. Do not use the ® symbol. Using ® on an unregistered mark is a misrepresentation that can be raised as a defense in an infringement action and, in some circumstances, can constitute fraud on the USPTO.
  • Our rights in these marks are common-law rights arising from actual use in commerce, limited to the geographic areas and classes of goods and services in which we actually use them.
  • If and when any mark is federally registered, this Policy will be updated to identify the registration number and the ® symbol will be used for that mark.

3. Ownership and Reservation of Rights

All marks identified in Section 2, together with all associated goodwill, are owned exclusively by Sports Media, Inc.

No license to use any mark is granted except as expressly stated in this Policy. Nothing on our Services, in our materials, or in any business dealing should be read as granting any license by implication, estoppel, or otherwise. All rights not expressly granted are reserved.

Any use you make of our marks inures to the benefit of Sports Media, Inc.

4. Uses That Do Not Require Permission

4.1 Referring to us and our products

You may use our marks to refer accurately to us or to our products — in an article, review, comparison, classroom discussion, bibliography, catalog listing, or ordinary conversation — provided that:

  • The product or company is not readily identifiable without using the mark
  • You use no more of the mark than is reasonably necessary
  • Nothing about your use suggests sponsorship, endorsement, affiliation, or certification by Sports Media, Inc.

This reflects the doctrine of nominative fair use. Descriptive fair use under 15 U.S.C. § 1115(b)(4) is likewise unaffected by this Policy.

Use the word mark in plain text. Do not substitute a logo where the name will do.

4.2 Teachers, coaches, and youth programs

This is the permission we most want you to use, and you do not need to ask.

If you are a teacher, coach, librarian, or youth program leader, we grant you a free, revocable, non-exclusive license to reproduce and display our marks and our free materials for non-commercial instructional use with the children in your own classroom, team, or group, provided the materials are unmodified and our name and notices remain intact.

That covers printing our activity sheets for your class, displaying our characters in your classroom, showing our videos to your group, and naming our books in your lesson plans and parent newsletters.

It does not cover: district-wide or school-wide distribution, posting materials to any site or drive reachable outside your own classroom, including our materials in anything sold or exchanged for value, or charging any fee for access. Those need a license — email info@championmvp.com and we will handle it quickly.

4.3 Press and media

Journalists, bloggers, reviewers, and podcasters may use our word marks, logos, cover images, and game screenshots in news coverage, reviews, and commentary, unaltered, without asking. Please attribute per Section 7.

4.4 Retailers and affiliates

Booksellers, distributors, libraries, and authorized affiliates may use our word marks, book titles, and cover images for the purpose of selling or lending our books.

You may not: alter cover art; suggest an exclusive, official, or authorized-dealer relationship that does not exist; use our marks in your own business name, domain, or social handle; or bid on our marks as paid-search keywords without our written permission.

5. Uses That Are Prohibited

Without our express prior written permission, you may not:

  • Alter the marks. Do not modify, recolor, distort, stretch, rotate, animate, add effects to, or combine our logos with other elements. Do not use a logo as part of a composite mark. Do not translate or transliterate our word marks.
  • Adopt our marks as your own. Do not use any of our marks, or anything confusingly similar, in your company name, product name, service name, domain name, subdomain, social media handle, username, app name, hashtag, or as a keyword or metatag. Do not apply to register any mark confusingly similar to ours, anywhere in the world.
  • Imply a relationship that does not exist. Do not use our marks in any way suggesting that Sports Media, Inc. sponsors, endorses, certifies, approves, is affiliated with, or is the source of your product, service, event, organization, program, or content.
  • Merchandise. Do not apply our marks or characters to apparel, toys, equipment, signage, printed goods, or any physical or digital product offered for sale, trade, or promotional distribution.
  • Use our characters outside our materials. Zoe, Mikah, TT, Coach Champ, Gigi, and Pip may not be reproduced, redrawn, costumed, performed, voiced, or depicted outside the materials we publish. This includes fan art offered for sale, mascot appearances, and any commercial use.
  • Use our marks in AI-generated or derivative content. Do not use our marks, characters, or trade dress to prompt, train, or generate content through any artificial intelligence system, and do not present any generated output as ours or as associated with us.
  • Use our marks in content unsuitable for children. Our marks may not be used in connection with, or in proximity to, content or products involving alcohol, tobacco, vaping, cannabis, gambling, firearms, adult content, political campaigning, or anything else unsuitable for a young audience, or in any manner that is deceptive, defamatory, obscene, discriminatory, or unlawful. This is the clause we will enforce most seriously, and we will act quickly on it.
  • Bury or diminish attribution. Do not remove, obscure, or minimize our trademark notices.

6. Logo Usage Standards

When you use one of our logos under a permission granted above:

  • Use only the current, approved artwork obtained from us. Do not recreate, trace, or approximate it.
  • Maintain the logo’s original proportions. Scale it, do not stretch it.
  • Maintain clear space around the logo equal to at least the height of the capital letters in the logotype.
  • Do not reproduce the logo smaller than legibility permits.
  • Place the logo on a plain background with sufficient contrast. Do not place it on a busy image or a clashing color.
  • Do not add a drop shadow, outline, glow, gradient, pattern, or any other effect.
  • Do not place the logo inside a shape, box, or lockup with other logos without permission.

7. Attribution

When attribution is appropriate, use this form:

When our marks appear in running text, do not pluralize, abbreviate, hyphenate, or use them as verbs. Use a mark as an adjective modifying a noun where the sentence allows it: “the Champion MVP program,” not “a Champion MVP.”

8. Third-Party Marks

Sports, league, team, event, and organization names and logos that may appear in our materials or on our Services are the property of their respective owners.

Their appearance does not imply any affiliation with, sponsorship by, endorsement by, or license from those owners, and we claim no rights in them. Where our books depict a sport generically, we do so descriptively and without reference to any league, club, or governing body.

Platform names including Amazon, Kindle, YouTube, and any social network are trademarks of their respective owners.

If you own a mark that appears in our materials and you believe it is used improperly, contact us at the address in Section 10 and we will address it directly and promptly.

9. Reporting Misuse, Enforcement, and Revocation

Report misuse. If you see our marks used in a way that appears unauthorized, or in a way that seems inappropriate for a children’s brand, tell us at info@championmvp.com with the subject line “Trademark.” Tell us where you saw it and include a link or screenshot if you can. We read every one of these.

We monitor and enforce. Sports Media, Inc. actively monitors use of its marks and will enforce its rights. Trademark rights weaken when they are not enforced, so we do not treat enforcement as optional.

Permission is revocable. Every permission granted in this Policy is a bare, revocable license. We may revoke any permission, as to any party, at any time, for any reason, with or without notice. On revocation you must cease the use promptly.

Requesting permission. For any use not expressly permitted here, write to info@championmvp.com with the subject line “Trademark Permission.” Describe the proposed use, where it will appear, for how long, and in what quantity, and include a mockup if you have one. We respond to reasonable requests promptly, and we say yes more often than not — particularly to educators, libraries, and youth organizations.

11. No Legal Advice; Changes

This Policy describes how Sports Media, Inc. permits its marks to be used. It is not legal advice, and it is not a warranty that any particular use is lawful. Compliance with this Policy does not guarantee that a use does not infringe the rights of some other party. If you are unsure, consult your own attorney.

We may revise this Policy at any time. The current version is always the one posted here, and the “Last Updated” date reflects the most recent change. Your continued use of our marks after a revision constitutes acceptance of the revised Policy.
